Terms of Use

1. Purpose and acceptance

These Terms of Use govern access to and use of the Modabillion online store, as well as the purchase of the women's fashion products offered therein.

By browsing, building your bag, or completing an order, you declare that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.

2. Data provided and accuracy

To complete a purchase, you provide data such as name, contact (WhatsApp/email), and delivery address.

You are responsible for the truthfulness, accuracy, and updating of the data provided. Incorrect or incomplete information may prevent the processing of the order or the delivery, with no liability on the part of Modabillion for delays or failures resulting therefrom.

3. Purchase and payment process

The purchase process works as follows:

• You build your bag, provide your name, contact (WhatsApp/email), and delivery address and, if you wish, apply a discount coupon.
• Upon checkout, you are directed to the SECURE environment of our payment processing partner (Stripe) to make payment by card, PIX, or boleto, according to the options available.
• Modabillion does NOT collect or store card data; payment is handled directly in the partner's environment. After confirmation, you return to the store with the order confirmation.
• Our WhatsApp, Instagram, and email channels are used for SERVICE and support (including answering questions and requesting exchanges), and not for making payments.

The order is only considered confirmed after payment approval by the processing partner. If payment is not approved, the order is not completed.

4. Prices, coupons, and availability

• Prices and conditions are those displayed on the site at the time the order is completed and may be changed at any time, without prejudice to orders already confirmed.
• Discount coupons (such as the grand-opening welcome coupon) are applied at checkout, before payment, and are subject to their own rules, deadlines, and availability.
• Products are subject to stock availability. In the event of unavailability after the purchase, we will contact you to offer an alternative or to issue a refund.
• Any evident errors in price or description registration may be corrected, with cancellation and refund of the order, where applicable.

5. Delivery and shipping

• Shipping is a flat R$ 19.90 and FREE for purchases above R$ 199.00, calculated at checkout.
• Delivery is carried out by operational logistics partners to the address you provided.
• Delivery times are estimates and may vary according to the region and external factors (carrier, logistics conditions). Responsibility for the sale lies entirely with Modabillion.

6. Virtual Fitting Room

The Virtual Fitting Room offers a GUIDANCE-ONLY size recommendation based on measurements provided by you (bust/waist/hips, or height and weight; for footwear, foot length in cm).

The measurements are processed exclusively in your own browser, are not sent to us nor stored by Modabillion, and the tool does NOT use artificial intelligence or photos.

This is an estimate: the final choice of size is always yours, and Modabillion does not guarantee a perfect fit based on the recommendation.

7. Exchanges and returns

You have the right of withdrawal under Article 49 of the Consumer Defense Code: you may request an exchange or return within 7 (seven) calendar days from receipt of the product.

• The request is made through our WhatsApp, providing the order number.
• The item must show no signs of use, with the tag attached and in its original packaging.
• For hygiene reasons, intimate items are NOT exchangeable.
• In the event of a product defect, the cost of the exchange/return shipping is borne by Modabillion.
• For an exchange by preference (no defect), the shipping conditions are arranged during service.

8. Intellectual property

All content on the site — including brand, name, logo, texts, images, photos, layout, and other elements — belongs to Modabillion or is licensed to it and is protected by the applicable legislation.

Reproduction, distribution, copying, or any commercial use without the prior written authorization of Modabillion is prohibited.

9. Responsibilities and limitations

• Modabillion strives to keep the information on the site correct and up to date, but there may be inaccuracies or temporary unavailability for technical reasons.
• We are not liable for failures arising from acts of God, force majeure, unavailability of the internet or of third-party services beyond our reasonable control.
• You undertake to use the site lawfully, without engaging in fraud or acts that harm the store, other users, or third parties.
• Nothing in these Terms limits or excludes the rights that consumer legislation guarantees you.

10. Customer service channels

For questions, support, orders, and exchange/return requests, use our official channels: our WhatsApp, our Instagram, and our email, indicated on the Contact pages and in the site's Help Center.

11. Changes to these Terms

Modabillion may update these Terms of Use at any time. The version in force will always be available on this page, with the date of the last update.

Continued use of the site after any changes represents your agreement with the updated version.

12. Applicable law and jurisdiction

These Terms are governed by Brazilian law, in particular the Consumer Defense Code (Lei nº 8.078/1990) and the LGPD (Lei nº 13.709/2018).

The jurisdiction of the consumer's domicile is hereby elected to settle any disputes.
